Welcome to RaffleRaise. These Terms of Use apply to all clients, visitors, and users of the RaffleRaise platform. Ticket buyers are subject to separate Terms and Conditions, presented at checkout, which govern their participation in individual raffles.
Raffle organisers must review and accept the Raffle Organiser Agreement when setting up each raffle. This agreement outlines the legal responsibilities and operational requirements specific to raffle activities. If there is any inconsistency between these Terms of Use and the Raffle Organiser Agreement, the latter will take precedence.
By accessing or using our services, you agree to these terms. If you are a raffle organiser, these Terms govern your general use of the platform, while your formal raffle obligations are set out in the Raffle Organiser Agreement.
1. Overview
RaffleRaise Pty Ltd (ABN 11 684 212 011) provides a technology platform that facilitates online raffles for eligible organisations across Australia. This includes digital ticket sales, secure payment processing via third-party providers, and optional electronic draw tools.
RaffleRaise acts solely as a third-party service provider and does not itself conduct raffles or hold any permits. The Raffle Organiser is solely responsible for obtaining all required permits, licences, and regulatory approvals, and for ensuring compliance with all applicable state and territory laws. RaffleRaise does not verify the accuracy of any permit or raffle configuration details and assumes no liability for misrepresentations or legal breaches by the Raffle Organiser.
2. Eligibility
2.1. Raffles run via RaffleRaise must be conducted by eligible organisations permitted to conduct raffles under applicable laws.
2.2. Raffle organisers are solely responsible for obtaining any required permits or licences before launching a raffle.
2.3. Users must be 18 years or older to create a raffle or purchase tickets.
3. Platform Services
3.1. RaffleRaise provides a secure online interface for eligible organisations to set up raffles, accept payments digitally, and access real-time reporting tools.
3.2. We issue digital tickets to buyers upon successful payment and provide optional electronic drawing tools for organisers who require them.
3.3. Organisers are responsible for inputting accurate raffle details including ticket pricing, prize information, draw dates, and terms and conditions.
3.4. Our platform is designed to support organisers in promoting transparency, maintaining accurate records, and complying with state and territory raffle laws.
3.5. RaffleRaise charges a service fee on each transaction, in addition to a third-party payment processing fee (charged by Stripe). Organisers have the option to pass the Stripe transaction fee on to ticket buyers during checkout.
4. Responsibilities of Raffle Organisers
By using RaffleRaise, organisers agree to:
4.1. Ensure compliance with all state and territory raffle laws and permit conditions.
4.2. Manage prize fulfilment and winner notifications.
4.3. Respond to customer queries, refund requests when legally allowed, and complaints.
4.4. Provide truthful and non-misleading prize and marketing information.
4.5. Maintain the security of their organiser portal login credentials.
4.6. Only promote raffles to individuals in jurisdictions where participation is permitted by law.
5. Fees and Payment
5.1. RaffleRaise charges a 4.40% platform service fee on all online transactions made through the platform.
5.2. Third-party payment (Stripe) fees of 1.70% + $0.30 per transaction also apply. Organisers have the option to pass this fee on to ticket buyers at checkout.
5.3. Funds are remitted to the organiser’s nominated account within 48 hours of the draw, subject to compliance.
Organisers are responsible for resolving any chargebacks or disputes with ticket buyers, subject to applicable laws and regulatory requirements.
6. Compliance and Fair Use
6.1. RaffleRaise reserves the right to suspend or remove raffles that do not comply with legal requirements or breach platform policies.
6.2. Raffles must not be used for unlawful fundraising or for-profit activities unless allowed by law.
6.3. Any suspected misuse or fraudulent activity may result in account suspension.
7. Privacy and Data Protection
7.1. Personal information collected via the platform is handled in accordance with our [Privacy Policy].
7.2. Organisers are granted limited access to ticket buyer data solely for prize fulfilment and winner notification.
7.3. Organisers may not use buyer data for marketing unless explicit consent is obtained.
8. Intellectual Property
8.1. All content, branding, software, and materials on the platform are owned by RaffleRaise or its licensors.
8.2. Organisers grant RaffleRaise a non-exclusive licence to use their branding for the purpose of promoting and displaying their raffle.
9. Limitation of Liability
9.1. RaffleRaise is not liable for any losses arising from organiser error, regulatory breaches, technical issues, or raffle-related disputes.
9.2. RaffleRaise is not responsible for the legality, conduct, or outcome of any raffle promoted or managed by an organiser.
9.3. RaffleRaise does not guarantee uninterrupted or error-free operation of the platform and is not liable for service interruptions, system failures, or third-party provider outages.
9.4. To the fullest extent permitted by law, our liability is limited to the total service fees paid to us in the preceding 12 months.
10. Modifications
10.1. RaffleRaise may update these Terms of Use at any time. Changes will be effective upon posting.
10.2. In addition to these Terms of Use, raffle organisers are required to review and accept the Raffle Organiser Agreement at the time of setting up each raffle. That agreement governs the specific terms, obligations, and legal responsibilities of the organiser in relation to the raffle.
10.3. In the event of any inconsistency between these Terms of Use and the Raffle Organiser Agreement, the Raffle Organiser Agreement will take precedence to the extent of the inconsistency.
